Criminal Liability and Compliance
We provide advice to companies on both the prevention of and the decision-making in reaction to crimes or administrative infringements, such as internal fraud, questioning from prosecuting authorities or fraud to third parties. We represent our clients in court in criminal proceedings, and we develop internal investigations in order to discover the scope of each contingency, collecting all available information and, according to each case, designing and developing defenses against accusations from the authorities, and preparing complaints or suits against third parties. We also provide compliance services for the implementation and monitoring of compliance models within the framework of Law 20,393 on criminal liability of legal entities, and we look for risk control mechanisms that are strong, efficient and consistent with the reality of each company.
